These terms cover your use of this website and any design work I carry out for you. A signed agreement or written quote takes priority where it says something different.

Using this website

The text, graphics, animations and code on this site are protected by copyright and belong to me or their licensors. You are welcome to browse and share links, but you may not copy or reuse them without written permission.

The information here is general and may change. Example images on this site are illustrations of the kind of work I do, not records of client projects.

How work is agreed

Every project is agreed in writing before it starts, and an exchange of emails is enough. The quote states the deliverables, deadlines and any milestones, the number of revision rounds, the price in euros, the usage rights, and the file formats.

Prices on this website are starting points, not fixed offers. The price that applies is the one in your quote. Changes to scope, deadline or price must be agreed in writing first, and work beyond the agreed scope or revision rounds is quoted separately.

What I need from you

  • A clear brief and your materials on time: texts, logos, images and brand guidelines.
  • Confirmation that you hold the rights to everything you send me.
  • One contact person who can give comments and approvals.
  • A final check of texts, prices and product details before you approve. You remain responsible for that content and for making sure your advertising meets the rules that apply to it.

Delivery, revisions and approval

Files are delivered electronically in the agreed formats. Deadlines move by the length of any delay on your side, such as late materials or comments.

You get the number of revision rounds stated in the quote. Please put all comments for a round into one written message.

You have 5 business days from delivery to approve the work or tell me in writing where it does not match the quote. If I hear nothing in that time, the work counts as approved. Approval may not be unreasonably withheld.

Prices and payment

Prices are in euros. VAT not applicable, art. 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI).

Unless the quote says otherwise, invoices are payable by bank transfer within 30 calendar days of the invoice date. No discount is given for early payment. If you dispute an invoice, tell me in writing with your reasons within 10 business days and pay any undisputed part by the due date.

For business clients, late payment automatically triggers penalties at three times the French statutory interest rate from the day after the due date, without prior notice, plus a fixed €40 recovery charge per invoice (Articles L441-10 and D441-5 of the French Commercial Code).

I will only ever ask for payment to the account shown on the invoice. If you receive a message saying my bank details have changed, check with me directly before paying.

Usage rights and copyright

The quote sets out which rights you receive, for which uses and media, in which territory and for how long, as required by Article L131-3 of the French Intellectual Property Code. Those rights begin once the work is approved and paid for in full. Until then, all rights stay with me and the work may not be used. Rights not expressly granted stay with me.

Unless the quote says otherwise, drafts, sketches, rejected proposals and source files remain mine. My moral rights as author are perpetual and cannot be waived (Article L121-1).

If the work includes stock images, fonts or other licensed items, I will tell you which ones. They stay subject to their owners’ licences, and any licence cost is stated in the quote.

I may show published work in my portfolio unless you object in writing or the quote says otherwise.

Confidentiality

I keep your non-public commercial, technical and financial information confidential and use it only for your project, and I ask the same of you for mine. This continues for 3 years after the project ends. It does not cover information that is already public, independently developed, lawfully received from someone else, or that the law requires to be disclosed.

Liability

I carry out the work with professional care and skill, under a best-efforts obligation (obligation de moyens). Each party is liable for direct damage caused by its proven fault. Neither party is liable for indirect damage, such as lost profit, lost business, lost data or damage to reputation.

My total liability for a project is limited to the price agreed for that project. This limit does not apply to wilful misconduct, gross negligence or personal injury, or where the law does not allow it.

Events outside our control

Neither party is liable for delays caused by force majeure under Article 1218 of the French Civil Code. If such an event lasts more than 30 days in a row, either party may cancel the affected work by written notice, and you pay for the work done up to that point.

If you are a consumer

My services are designed for businesses. If you hire me as a private individual, French consumer law applies alongside these terms. You may have a 14-day right to withdraw from a contract concluded at a distance (Article L221-18 of the French Consumer Code), with exceptions including work made to your personal specifications and services fully performed with your prior agreement (Article L221-28).

You can also refer a dispute to a consumer mediator free of charge (Article L612-1). Ask me for the mediator’s details.

Personal data

The Privacy Policy explains how I handle personal data. Where I process personal data on your behalf, we will sign a data processing agreement under Article 28 of the GDPR.

Governing law and disputes

These terms and any project are governed by French law. If we disagree, we will first try in good faith to settle it within 30 days of written notice. If that fails, the dispute goes to the competent French court under the statutory rules of jurisdiction.

Changes to these terms

I may update these terms. The version that applies to a project is the one in force on the date of your quote.
